Course Description

Christopher Ondeck, Partner, Proskaur Rose, LLP will be leading this one hour session designed to give you a better understanding how most agricultural cooperatives depend on the anti-trust protections provided by the Capper Volstead Act, but do you really know what it says, and what it means for your cooperative.  This session will provide a history and overview of the Act, and how it is relevant to your cooperative today.  It will also provide you with an update on current developments in this area, including several class action law suits against cooperatives where plaintiff attorneys are challenging certain practices by the cooperatives and their members.  You will learn the “best practices” to help keep your cooperative safe from these types of cases.

Presenter: Christopher Ondeck, Partner, Proskaur Rose, LLP.

Chris Ondeck is a partner in the Litigation Department and co-chair of the Antitrust Group. He focuses his practice on representing clients in civil and criminal antitrust litigation, defending mergers and acquisitions before the U.S. antitrust agencies, defending companies involved in government investigations, and providing antitrust counseling. Chris has handled antitrust matters for clients in a number of industries, including advertising, aerospace, alcoholic beverages, appliances, building materials, defense, medical devices, metals, mining, natural resources, oil and gas, packaging, pharmaceuticals, software, and telecommunications. He also has developed substantial experience advising clients regarding the application of the antitrust laws to the pharmaceutical industry, the agriculture industry, trade associations, and the energy industry. Chris has particular experience with the antitrust issues involved with agricultural cooperatives. For 18 years he has defended the use and application of the Capper-Volstead Act's antitrust exemption for agricultural cooperatives, their members, and their agents in court cases, arbitrations and government investigations, and he has published extensively on the topic. He currently represents clients in the nationwide antitrust class action litigations in the egg, potato, and mushroom industries. He also advises cooperatives on structuring and incorporation, governance, pooling issues, agency agreements, surcharges, labor issues, use of agents, and animal welfare practices Chambers USA, which ranks Chris as a leading antitrust lawyer, called him a "rising star," noting that clients describe him as "our primary thought partner - he's very good at explaining the complex issues and making them easy to understand" and praise him for "his strong advocacy skills." He was also recognized by Law360 as one of the ten "rising stars" in antitrust law in 2010. Chris is a frequent speaker on antitrust topics, and is the author of the Supply Control White Paper, published in 2009 by the National Council of Farmer Cooperatives. Chris moderated the 2012 Capper-Volstead Conference, and serves by appointment as the vice-chair of the Capper-Volstead Sub-Committee of the National Council of Farmer Cooperatives. Prior to joining Proskauer, Chris was a former vice-chair of Crowell & Moring’s Antitrust Group and co-chair of its Trade Association Group.

  • Participants are able to participate using any device with an Internet connect (if the device does not have speakers, the participant can also dial-in) or they can participate with audio only by dialing in.
  • All registrants will receive a link to the CLN’s recording by email within 48 business hours of event’s conclusion.
  • There will be assistance available to help with technical and connectivity issues up to 10 minutes prior to the start of the presentation.

Registration

All registration is done on-line and each guest must provide their name and email address to participate. All NSAC members may register for free. Non-members may register for a nominal fee.

Refund Policy

NSAC will not issue refunds for CLNs. If a registrant is unable to participate in the CLN and provides notification to info@nsacoop.org 48 hours prior to the session, a credit will be provided for a future CLN. Alert the NSAC staff member monitoring the CLN if technical difficulties are encountered and technical support will be provided to eliminate problems with future CLNs.

Additional Information

Live participation is required for CPE credit and polling questions must be answered to document your active participation. All registrants will receive an email following the session with links to the slides and/or handouts, and a link to the CLN recording (unless otherwise stated). If you are unable to participate in the live session, you can still watch the recorded session, but you will not be eligible for CPE credits. Those eligible for credits will receive their certificate by email with 7 business days.
